License Agreement
Move-N Software by Move-N Software, Inc.
Use of this product constitutes your acceptance of these terms and conditions and your agreement to abide by the following terms and conditions.
This is a legal agreement between you, the purchaser and end user, and Move-N Software, Inc. By using this Software program, you are agreeing to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement promptly return the program disks and all the accompanying items (including written materials and binders or other containers, security keys, etc.) within thirty (30) days to Move-N Software, Inc. for a refund, less the shipping and handling charges. Returns are subject to a 15% restocking fee.
You, the original purchaser, are granted a nonexclusive license to use this Software under the terms stated in this Agreement. This license allows you to use the Software on a single (one) computer unless the network version has been purchased and appropriately licensed. You may not rent or lease the Software, but you may transfer it on a permanent basis if you have written consent from authorized personnel at Move-N Software, Inc. Once written permission is obtained, the person(s) receiving the Move-N Software must agree to the terms of the Agreement and provide Move-N Software, Inc. written notification of the transfer within ten days prior to the transfer. If the Software is an update, any transfer must include the update and all prior versions.
If you receive periodic program updates and modifications, then you may use only the disks appropriate for your one computer unless the network version has been purchased and appropriately licensed. You may not use the other disks on another computer or loan, rent, lease, or transfer them to another user except as part of the permanent transfer (as provided above) of all the Software and accompanying items.
The Software and accompanying documentation are provided "as is" without warranty of any kind. You assume the entire risk as to the results and performance of the Software.
Move-N Software, Inc. will not be liable for any special, incidental, consequential, indirect or similar damages due to the loss of data, loss of business profits, business interruption or any other reason, even if Move-N Software, Inc. or an agent of Move-N Software, Inc. has been advised of the possibility of such damages. In no event shall Move-N Software, Inc. liability for any damages ever exceed the price paid for the license to use the Software, regardless of the form of the claim.
This Agreement shall be construed and enforced in accordance with the laws of the State of Texas. Any action or proceeding brought by either party against the other arising out of or related to the Agreement shall be brought only in a State or Federal Court of competent jurisdiction located in Tarrant County, Texas. The parties hereby agree to in personam jurisdiction of said courts.
If any provision of this Agreement is found void, invalid or unenforceable, it will not affect the validity of the balance of this Agreement, which shall remain valid and enforceable according to its terms.
